After hearing the learned Counsel for the appellant to some extent and considering the fact that now the case is already fixed for the evidence and on merits also, I have shown my disinclination to grant bail to the present appellant.

The earlier application is also rejected and there is no change in the circumstances.

In view of that, learned Counsel for the appellant seeks permission to withdraw the application with liberty to file afresh after nine months if there is no substantial progress in the trial.

Permission is granted to withdraw the application. 6.
The application is disposed of as withdrawn with liberty as prayed for.
