This is an application for cancellation of Non Bailable Warrant issued on 24.10.2018.

On 24.10.2018, the matter was listed before this Court (Coram : Z.A. Haq, J.). Since learned counsel for applicant-Ranjeet s/o Sitaram Sahare did not appear before the Court nor he collected the paper-book, this Court (Coram : Z.A. Haq, J.) issued Non Bailable Warrant for securing the presence of applicant-Ranjeet. 3.

Prior to execution of the said warrant, the present application is moved by applicant-Ranjeet for cancellation of the Non Bailable Warrant.

It is submission of learned counsel Shri R.K. .....2/-

Patil representing applicant-Ranjeet that earlier counsel could not remain present before the Court due to his illness. Applicant-Ranjeet after acquiring knowledge of issuance of the Non Bailable Warrant, immediately moved the application for cancellation of the Non Bailable Warrant. On 13.11.2018, the Honourable Vacations Judge (Coram : Manish Pitale, J.) stayed the execution of the Non Bailable Warrant. Consequently, the Non Bailable Warrant is not executed.

Today, applicant-Ranjeet is personally present in the Court. He is duly identified by his Advocate Shri R.K. Patil. Even, learned Additional Public Prosecutor Mrs. S.V. Kolhe for the State submits that the Non Bailable Warrant is not executed against applicant-Ranjeet.

In that view of the matter, the present application is allowed. The Non Bailable Warrant issued against applicant-Ranjeet is hereby cancelled. 7.

Learned counsel Shri R.K. Patil for applicantRanjeet submits that he has already collected the paperbook. 8.

The criminal application stands disposed of as such.

Criminal Appeal No.352/2007 1.

In the present appeal, on 24.10.2018 Non .....3/-

Bailable Warrant was issued by this Court (Coram : Z.A. Haq, J.) since learned counsel for appellant-Ganesh remained absent.

Learned Additional Public Prosecutor Mrs.

S.V. Kolhe for the State submits that inspite of best efforts taken by the police department, as on today the Non Bailable Warrant is not executed.

In that view of the matter, the concern police station is directed to execute the Non Bailable Warrant, at the earliest.
