The learned School Tribunal had allowed the appeal partially by granting relief of reinstatement along with 30% back wages. It is not in dispute that a statement that the appellant was not gainfully employed elsewhere, was not made either in the memorandum of appeal or in any separate affidavit. Despite this, the learned School Tribunal granted reinstatement with 30% back wages.

The appellant had filed petition before this Court seeking enhancement in the amount of back wages. However, this Court has dismissed the petition observing that there was no statement either in the appeal or in any separate affidavit as the appellant was not gainfully employed. It will be pertinent to mention that the Management had also filed petition challenging grant of back wages. However, having regard to the statement made in the appeal regarding ailment of the appellant, this Court has dismissed petition of the Management as well. This is an application for review filed by the appellant-employee seeking review of the said judgment in order to seek enhancement in the amount of back wages awarded.

Perusal of the application will demonstrate that no ground for interference is made out in order to seek further enhancement in the amount of back wages, specially having regard to the limited scope of review. The application for review is, therefore, rejected. No costs. JUDGE *sandesh
