Heard Shri M.N. Ali, learned counsel for the applicant and Shri H.R. Dhumale, learned APP for the respondent - State.
The prosecution story is based on dying declaration of the deceased. The first dying declaration shows that she was burned by her husband. She has not given name of the applicant in the first dying declaration whereas in the second dying declaration, she has stated the name of the applicant.
Looking to the contrary statements of the deceased, the applicant is entitled to bail. Hence, the following order :
The application is allowed.
(i) The applicant be released on executing PR bond of Rs.25,000/- with a solvent surety of like amount. (ii) He shall not tamper with the prosecution witnesses. (iii) He shall attend the trial on each and every date before the trial Court.
(iv) He shall attend the Police Station Dhamangaon Badhe, District - Buldhana, once in a month till the completion of trial.
