CRIMINAL WRIT PETITION NO. 778/2024 4] At this stage, the Counsel for the petitioner submits that the petition has been filed under Article 226 of the Constitution of India as also under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). She submits that she will pursue remedy under Section 528 of the BNSS.

5] That being so, the petition shall be treated as an application under Section 528 of the BNSS. 6] List before appropriate Bench.
