Heard Shri B.H. Tekam, learned counsel for the applicant and Shri H.D. Dubey, learned APP for the nonapplicant/State. The applicant was a Taluka Agricultural Officer and retired in the year 2014. The incident lodged against him is of the year 2010. The First Information Report shows that amount was deposited. However, it does not show that the applicant has received the amount and not deposited the same.

The report shows that the amount was deposited in Maharashtra State Co-operative Marketing Federation Limited, Bhandara. However, it does not show that the applicant had withdrawn the said amount. The applicant had given explanation dated 13.12.2014.

Hence, ad-interim anticipatory bail granted to the applicant on 13.11.2018, is hereby confirmed. JUDGE rkn
