DATE : December 19, 2019 The order dated 20/07/2019 passed by the Additional Collector under Section 247 of the Maharashtra Land Revenue Code, 1966 (for short, the said Code) is under challenge. It is found that remedy of filing a revision application for challenging that order is available with the petitioner under Section 257 of the said Code.

Shri R. S. Kurekar, learned counsel for the petitioner on instructions submits that the petitioner would avail that remedy within a period of two weeks from today. It is submitted that pursuant to the notice dated 09/12/2019 the lands in question are to be measured on 20/12/2019. Though such measurement may take place, for a period of fifteen days thereafter the Circle Officer may not take any other steps pursuant to that measurement. It is open for the petitioner to seek interim relief before the Divisional Commissioner. All points raised are kept open. The Writ Petition is accordingly disposed of. No costs. Authenticated copy of this order be supplied to the counsel for the petitioner.
