The applicant is arrested in Crime No.493 of 2025 registered with Police Station Kamptee, district Nagpur for the offence punishable under Sections 59 of the Food Safety and Standards Act, 2006 and under Sections 123,274,275,223 of the Bharatiya Nyaya Sanhita, 2023. 2.
On receiving the secret information, the raid was conducted. The scented tobacco, gutkha, scented Supari and pan masala worth Rs.76,606/- came to be seized from Swanit Kirana Store, owned by applicant. Thereafter, the material was seized and the report came to be registered against this applicant. The applicant was taken in custody at the time of raid.

3. The learned counsel for the applicant has stated that there are no antecedents. The learned counsel for the applicant has stated that the applicant is in jail since last two months. The material is already seized. There are no antecedents against this applicant. There is no need to keep him behind the bar. Hence, prayed to release the applicant on bail.
4. The learned APP has opposed the application and stated that applicant is found in the possession of contraband articles. He is having the grocery shop and is doing these activities. He was arrested on the spot. Hence, prayed to reject the application.
5. Heard both the sides and perused the record.
6. On receiving the secret information, the raid was conducted and the material is seized on the spot. The charge-sheet is filed. Investigation is completed. There is no need to keep the applicant behind the bar. Accordingly, I pass the following order:
i) The Criminal application is allowed.
ii) Applicant - Ashish Manikraoji Raut be released on bail in Crime No.493 of 2025 registered with Police Station Kamptee, district Nagpur for the offence punishable
3 / 3 42-BA 1245-25 under Sections 59 of the Food Safety and Standards Act, 2006 and under Sections 123,274,275,223 of the Bharatiya Nyaya Sanhita, 2023, on his furnishing P.R. Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with solvent surety in the like amount before the trial Court. iii] The applicant shall not in any way tamper with the prosecution evidence.
iv] The applicant shall not pressurize or threaten the prosecution witnesses.
v] The applicant shall co-operate the learned trial judge in the conduct of the trial.

The Criminal Application stands disposed of accordingly.

Pending application, if any, is/are stand/s disposed of.
