The applicant has apprehension of arrest in Crime No.216/2025 registered with Police Station Gondia City, District Gondia for the offences punishable under Sections 420, 468, 471, 474 read with Section 34 of the Indian Penal Code.

It is alleged that the applicant is Councilor and has issued the certificate and on the basis of the said certificate, the death certificate is prepared and the name of the first informant is deleted from the property card. The private complaint was filed and the process under Section 156(3) of the Code of Criminal Procedure was issued. The crime is registered.

The learned Counsel for the applicant has stated that the applicant has not issued the death certificate. She has issued the certificate which was blank and it was signed by the applicant. The signed form was kept in her house and said form was misused and the death certificate is prepared on the basis of the said certificate. The applicant has not forged any document. Hence, prayed to protect the applicant by granting anticipatory

The learned A.P.P. has opposed the application stating that five more signed blank certificates were found in her house during house search. As the allegations are made and on the basis of the said certificate, the death certificate is prepared, prayed to reject the application. 6.
Heard the learned Counsel for the applicant and the learned A.P.P. for the State.

The offence is registered on the private complaint lodged by the first informant. The allegations against this applicant are about issuing certificate. It appears from the blank certificate which is produced before this Court that it is signed by the applicant and it is the certificate in format about the person, who resides in said village. On the basis of said certificate, the death certificate is prepared and it is used.

As the documents are already seized, her custody is not required for further investigation. Hence, the case is made out to protect the applicant by granting anticipatory bail. Accordingly, I pass following order: i] It is directed that in the event of arrest of the applicant in connection with Crime No.216/2025 registered with Police Station Gondia City, District Gondia for the offences punishable under Sections 420, 468, 471, 474 read with Section 34 of the Indian Penal Code, she shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount.
3 12.aba.856.25 ii] The applicant shall not in any way tamper with the prosecution evidence.
iii] The applicant shall not pressurize or threaten the prosecution witnesses.
iv] The applicant shall attend the concerned police station whenever called by the Investigating Officer.
v] Since the charge-sheet is already filed the applicant to co-operate with the trial.
vi] The applicant shall co-operate the investigation officer.
The application stands disposed of.
