The petitioner has an alternate and efficacious remedy available viz to file an appeal under Section 137 of the Maharashtra Prohibition Act, 1949. The petitioner may avail the same.

Learned Counsel for the petitioner submits that the petitioner shall file appeal within two weeks from today but makes a request that the appeal may be made time-bound. He submits that unless it is so done, the State Government may not decide the appeal expeditiously.

On the strength of the statement, so made, we permit the petitioner to approach the appellate authority under Section 137 of the Act of 1949. If the appeal is so filed, the same shall be decided by the appellate authority within three months from the date of filing appeal.

The time spent in pursuing the cause before this Court shall be excluded in terms of Section 14 of the Limitation Act, 1963.
