The conviction is under Section 376 (2) (i) of Indian Penal Code read with Section 6 of the Protection of Children from Sexual Offences Act, 2012 (POCSO). 2.

I have perused the reasoning of the learned Sessions Judge.

In view of the nature of allegations, I am not inclined to suspend the sentence.

However, since the sentence is not being suspended, list the appeal for hearing immediately after the paper book is ready.

If the appeal is not heard within six months, the
