F.C. APPEAL (ST) NO. 25342/2023 1.
This is a joint appeal of husband and wife who urged to the Family Court for entertaining petition under Section 13-B of the Hindu Marriage Act by curtailing period of separation of one year as has been incorporated in Section. The Family Court rejected to entertain petition for the reasons that no exceptional circumstances as hardship is shown to curtail the mandatory period.
