This is an application seeking for condonation of delay of 32 days.

F.C. APPEAL (ST) NO. 25342/2023 1.

This is a joint appeal of husband and wife who urged to the Family Court for entertaining petition under Section 13-B of the Hindu Marriage Act by curtailing period of separation of one year as has been incorporated in Section. The Family Court rejected to entertain petition for the reasons that no exceptional circumstances as hardship is shown to curtail the mandatory period.

Since there is no rival, considering the nature of litigation, we deem it necessary to request the learned APP Mr. M.K. Pathan to assist on behalf of State. 3.
