This contempt petition is with regard to non-compliance of the order dated 22/12/2016 in Writ Petition No. 4598/2003 wherein in paragraph No. 22, this Court allowed the petition in terms of prayer clauses (i) and (i-a) and directed that all the emoluments till date the petitioner was in service, shall be paid to him within a period of three months from the date of the order. After notice was issued in the contempt petition, the learned Additional Solicitor General of India made a statement on 05/02/2021 that all emoluments have been paid to the petitioner.
The petitioner in his additional affidavit dated
03CP307.17.odt 08/02/2021 has stated that the petitioner has received all the dues till termination of his service as directed. However, the petitioner raised the grievance that he is not paid the gratuity amount.
On perusal of the prayers of the petitioner in the aforesaid petition qua the order passed by this Court, which is at page 33 of this petition, in our considered view, the order has been duly complied with. If the petitioner has any grievance for non receipt of the amount of gratuity, he is at liberty to agitate his grievance in an independent proceeding.
In this view of the matter, we find that the grievance of the petitioner is redressed and hence the contempt petition is disposed of accordingly with no order as to costs.
