The applicants have apprehension of arrest in connection with Crime No. 448 of 2025 registered with nonapplicant Police Station, Sakkardara, Nagpur for the offence punishable under Sections 316(2), 318(4), 336(3), 340(2), R/w. 3(5) of the Bharatiya Nyaya Sanhita , 2023.

The prosecution case in short is that, the informant, aged 21-year-old medical student from Saoner, Nagpur, approached the applicant, accuse No.1 Dr. Atul Rameshwar Ingole, through his firm, People-link Placements Pvt. Ltd., after reading advertisements promising MBBS admissions abroad at affordable packages. Induced by assurances of securing admission to Columbus Central University (CCU),
2 / 5 16-aba-862-25 Belize, Central America, through collaboration with R.J.S. College, Kopargaon, Ahmednagar, the informant and her family paid substantial sums of Rs.26,00,000/- through educational loan transferred to an American account i.e. American Academic Services, Ohio, USA. Only Rs.3,00,000/- was refunded to the complainant, leaving a net loss of Rs.25,60,000/-. The informant alleges fabrication of documents, including acceptance letters, mark sheets, and student IDs from fake e-mail. There was provision of only basic science training at R.J.S. College instead of proper MBBS curriculum, and repeated delays in travel to Belize under false pretext. The applicants/accused took a sham predeparture meeting on 20.08.2023 at Legend Inn Hotel, Nagpur, attended by the applicants alongwith Accused Nos.1- Atul Ingole, accused no.2 Venkat Reddy, and accused no.3 Umang Patel. The accused conspired to exploit the complainant's trust, using forged affiliations with CCU to siphon funds, with no actual admission or education provided. The complaint was lodged and the crime is registered.
3. The learned counsel for the applicants has stated that the applicants in both the applications are recruiters in Columbus University, they have not cheated anyone. The first informant has asked for refund of amount and some of the amount was refunded. The amount was not transferred
3 / 5 16-aba-862-25 in the account of these applicants. There is delay of three years. Earlier, she has lodged the complaint before the police Station. Cognizance was not taken, thereafter, she has lodged the private complaint before the Magistrate to take the cognizance under Section 156(3) of the Code of Criminal Procedure, where she has not attended the Court and the case is pending. Thereafter, in 3rd attempt, the crime was registered. Before filing of this complaint, she has passed some defamatory comments on Google and the applicants have filed the defamation suit. Thereafter, she has again lodged the complaint and the crime is registered.
4. When the applicants were on interim protection granted by the trial court, they have attended the police station. The University and these applicants are two separate entity. Some of the students are studying abroad. This is a case of recovery. Hence, prayed to protect the applicants by granting anticipatory bail as the custodial interrogation is not required.
5. The learned APP has opposed the application stating that there is no collaboration of RJS. The statement recorded by the police of Chairman of said RJS clearly shows that they are not attached with this people-link placement private limited. The certificate which is given is also given by one of the accused-Mr.Reddy. Fake Ids are used. The students have
4 / 5 16-aba-862-25 stated that only the basic knowledge of science is given during their training period. Other students have also lodged the complaints, which are pending before the police station. The custodial interrogation of these applicants is necessary. Hence, prayed to reject the application.

Heard both the sides and perused the record.
7. The applicants, who are the directors of the people link placement Private Limited, on perusal of the FIR, it appears that other students are already placed in the said University. Because of delay, the first informant has asked for refund of amount and when she did not get it, she has lodged the complaint. Considering the documents filed on record and as the defamation suit is also pending and the case is relied on the documents, custodial interrogation of these applicants is not required. Hence, the following order. i] It is directed that in the event of arrest of the applicants- Atul Rameshrao Ingole and Shital Vinayakrao Sukalkar, in connection with Crime No. 448 of 2025 registered with non-applicant Police Station, Sakkardara, Nagpur for the offence punishable under Sections 316(2), 318(4), 336(3), 340(2), R/w. 3(5) of the Bharatiya Nyaya Sanhita , 2023 they be released on bail on furnishing P.R.
5 / 5 16-aba-862-25 Bond in the sum of Rupees Twenty Five Thousand each with one surety in the like amount.
ii] The applicants shall not in any way tamper with the prosecution evidence.
iii] The applicants shall not pressurize or threaten the prosecution witnesses.
iv] The applicants shall attend the concerned police station on every Monday, Wednesday and Friday between 7:00 p.m. and 9:00 p.m. till filing of the charge-sheet. v] The applicants shall co-operate the investigating officer.
