The appeal that was admitted on 23.09.2014 was dismissed for non-filing of paper book. The learned counsel for the applicant on instructions assures that paper book would be filed within one week from today.

The statement that is made on instructions is accepted as an undertaking. If the paper book is not filed, the order dismissing the appeal would govern the field. The first appeal is restored to file subject to payment of costs of Rupees Five Hundred to the High Court Bar Library, Nagpur within a period of one week.

The application is allowed in aforesaid terms and disposed of.
