CORAM: ANIL L. PANSARE AND RAJ D. WAKODE, JJ. DATED : 16/12/2025.
On 08.12.2025, following order was passed :
"The petitioners have approached this Court with the prayers for directions to the respondents to release and pay the outstanding amounts towards reimbursement of fees for the students admitted in 25% RTE quota in petitioners schools. According to the petitioners, they are entitled for reimbursement in terms of The Right of Children to Free and Compulsory Education, Rules, 2010 (for short, Rules of 2010).
2. We fail to understand that if the petitioners schools are entitled for such reimbursement in terms of Rules of 2010, why should the petitioners be required to approach this Court for such legitimate relief.
3. According to the petitioners, prime responsibility is of respondent No.3 the Director of Primary Education, State of Maharashtra.
4. We are informed that respondent No.6Education Officer (Primary), Zilla Parishad, Wardha has approved and cleared the bills way back and has forwarded the same to respondent No.3.

5. The learned Assistant Government Pleader shall take instructions as to why the bills, though cleared by respondent No.3, have been not paid to the petitioners.
6. We may consider making recommendation of enquiry against erring officers if it is found that there is no justification for delay in processing the bills.
7. List in the next week."
2.
In response, the learned Assistant Government Pleader, on insturctions, submits that the entire amount due and payable to the petitioners, shall be paid on or before 20th February, 2026.
