The appellant initially filed a suit for eviction, which came to be dismissed vide order dated 18.08.2018. Being aggrieved, this is a First Appeal against the refusal to grant possession decree. 5.

During pendency of the appeal, the parties have amicably settled by arriving on certain terms, which are contended in the Pursis.

In view of that, the appellant seeks permission to withdraw the appeal.

The Director of the appellant - Company namely Krishnakumar Mohta is present in the Court. He has signed the Pursis, stated about the settlement and his non-inclination for continuation of the appeal.

Respondent no.1 Deepak Joshi is also present in the Court. He has also agreed the settlement and gave his no objection for withdrawal of money by the appellant as stated in the Pursis.

In view of the above, the appeal stands disposed of since withdrawn. The appellant is permitted to withdraw the amount as mentioned in the Pursis. 10.

Court Fee, be refunded as per the Rules.
