Heard the rival submissions.

The applicant/Acquiring Body has filed this application for condonation of delay of 320 days in filing the appeal against the Judgment and Award dated 26.10.2018 in L.A.C. No.47 of 2009.

The respondents/Claimants despite service remained absent. However, the learned Assistant Government Pleader appearing on behalf of respondent nos.3 and 4, did not raise any strong objection. 4.

As such, considering the reasons stated in the application and in the interest of justice, the application stands allowed and the delay is condoned, subject to costs of Rs.500/- to be paid to the Registry of this Court within two weeks, for utilization of the High Court Dispensary.

The application is disposed of.

The appeal be registered after deposit of costs and on removal of all the office objections, if any.

There shall be stay to the execution of impugned Judgment and Award dated 26.10.2018 in L.A.C.No. 47/2009, subject to deposit of entire amount of compensation along with the accrued interest, till date within the period of eight weeks.
