This Court (Coram: A. B. Chaudhari, J.) on 15.06.2015, partly allowed Criminal Appeal No.535/2011 filed by the present applicant. By the said judgment, order of conviction under Section 457 of the IPC was set aside and instead of that the present applicant was held guilty for the offence punishable under Section 454 of the IPC and was directed to suffer rigorous imprisonment for 8 years and to pay a fine of Rs.10,000/-, in default to suffer imprisonment for one year. Rest of the judgment and order was confirmed by this Court.
By the present application, the applicant wants to modify order dated 15.06.2015 praying to reduce the above fine amount of Rs.10,000/- to Rs.3,000/-.
appa1134.18.odt After hearing the learned counsel for the applicant, I see no merit in the application and I see no reason to interfere with the order passed by this Court. Hence, the application is rejected.
Mr. Chhabra, learned counsel appointed through Legal Aid Committee shall be paid Rs.1,500/- towards his professional fees.
