By these applications, the applicants are seeking setting aside the abatement of appeal against the appellant, who was reported to be expired on 21.08.2024 and permission to bringing legal heirs of the appellant. 3.

Since the right to sue is surviving in favour of the legal heirs of the appellant and for the reasons stated in the applications, the applications are allowed.

We hereby set aside the abatement against the appellant.

Appellant to carry out necessary amendment within a period of one week and supply the amended copy of paper book on other side on or before the next date. 6.

List the matter for further consideration, in the 1st week of October, 2025.
