By way of this petition, the petitioner is praying for direction to respondents to pay pension to the petitioner. 3.

It is the case of the petitioner that before attaining the age of 58, he submitted proposal for pension which was not accepted on the ground that on completion of 58 years of age, such proposal be submitted. On completion of 58 years of age, such proposal was submitted which was not accepted on the ground that it has to be filed online with joint declaration along with the employer. He accordingly submitted the joint declaration signed by him to the employer i.e. respondent No.2.

As per the reply of respondent No. 2, the respondent No. 2 by completing the said joint declaration and signing it forwarded it to respondent No. 4 by generating UN number on 22.12.2002 and on 19.7.2023 and thereby completed the formalities on part of respondent No. 2 for submission of joint declaration. 2 950wp184.2024..doc formalities for approval and releasing of the pension in favour of the petitioner has already been complied with.

In the present matter, this Court issued notice on 10.1.2024 and despite the same, till date, respondent No. 4 has not filed reply. Thus, it is evident that even after lapse of 22 months, there is no response from respondent No.4.

In the above referred backdrop, considering that the petitioner is claiming pension and he is waiting for the same from month of April 2019, we are of the opinion that the petition be disposed of with direction to respondent No. 4 to complete the process and release pension in favour of the petitioner, within stipulated period. 7.

Accordingly, writ petition is disposed of with direction to respondent No. 4 to act upon the joint declaration and the proposal submitted by the petitioner and respondent No. 2 jointly, for release of pension in favour of the petitioner, as stated in the affidavit of respondent No.2 and release the pension in favour of the petitioner, within 12 weeks from today.
