This is an application for restoration of appeal which stood dismissed, due to non-filing of the private paper book by the appellant within the stipulated period of time. It is accompanied by an application for condonation of delay in moving the application for restoration. For the reasons stated in the applications, same are allowed, delay is condoned and the appeal is restored subject to the counsel for the appellant filing private paper book within a period of one week from today.

Civil Application No. 702/2018 This is an application filed on behalf of the respondent no.1-claimant for withdrawal of balance amount of compensation lying in this Court as he was earlier permitted to withdraw 50% of the amount by order dated 8.7.2011 passed by this Court.

CAO313-18.odt It is pointed out in the application that the respondent no.1-claimant is in urgent need of the money because the marriage of his elder daughter is fixed on 27.03.2018. Hence for the reasons stated in the application, same is allowed and the respondent no.1 is permitted to withdraw the balance amount of compensation lying in this Court subject to filing usual undertaking. Application is disposed of.
