Heard learned counsel appearing for the respective parties.

This application has been taken out by Respondent no.1 for seeking expeditious hearing of First Appeal No.1224/2017. The grounds for seeking early hearing are stated in paragraph no.3 of the application. 3.

The learned counsel for the Appellant very fairly submits that the said grounds cannot be denied, however, he points out that by interim order of this Hon'ble Court, the Applicant was permitted to withdraw the sum of Rs.25,00,000/- in order to meet the exigencies. He, therefore, submits that the application be granted and the case be placed for final hearing. This

submission of Shri Anthony, learned counsel appearing for the Appellant is appreciated and is very fair. 4.

Accordingly the application is allowed and First Appeal No.1224/2017 may be placed for hearing on the Regular hearing board.
