The applicant is arrested in connection with Crime No.69 of 2017 registered with Police Station Goregaon, Tahsil Goregaon, District Gondia for the offences punishable under Section 376(2)(I) of the Indian Penal Code read with Sections 4 and 10 of the Protection of Children from Sexual Offences Act, 2012.

The charge-sheet is already filed. The case is already registered as Special (POCSO) Case No.23 of 2017 and is pending on the file of learned Additional Sessions Judge-II at Gondia.

After hearing, learned counsel Shri V.S. Mishra for the applicant submits that he wishes to withdraw the present application. He submits that directions be given to learned Judge of the Court below for expeditious Trial. 5.
Expeditious Trial is a right of under Trial.

In that view of the matter, the criminal application is dismissed as withdrawn with a direction to learned Additional Sessions Judge at Gondia, on whose file Special (POCSO) Case No.23 of 2017 is pending, to decide and dispose of the same within a period of one year from today. JUDGE !! BRW !!
