These 3 applications arise out of Crime No.54/2019 registered with Dhanora Police Station, District Gadchiroli for offences punishable under Section 307 read with Section 34 of the Indian Penal Code and under Sections 65(a)(e), 83, and 98 of the Maharashtra Prohibition Act, 1949.

Heard learned counsel Shri A.Anantkrishnan for the applicant in Criminal Application No.1172/2019, learned counsel Shri S.B.Bawanthade for applicants in Criminal Application No.1202/2019, and Advocate Shri A.R.Sharma h/f learned counsel Shri Amol Mardikar for the applicant in Criminal Application No.1203/2019. In all applications, the State is represented by learned Additional Public Prosecutor Shri N.B.Jawade.

Investigation is over, chargesheet is filed, and applicants are in jail from 29.8.2019.

According to the prosecution, first informant Saira Islamdin Shaikh, along with other members of Committee working against liquor, was searching as to anybody is selling liquor in Gadchiroli district. According to the prosecution case, a vehicle i.e. MH-33/T/0899 driven by Vyankatesh Narayan Bahirwar tried to run over Saira, however she was pulled by another lady Bindia Madkam. 5.
Co-accused Vyankatesh is already released on bail by this Court on 17.12.2019.

According to the prosecution, applicant-Deepak .....3/-
@ Dilip s/o Dhiwru Kukadkar was driver of another vehicle which passed from road prior to passing of vehicle driven by co-accused Vyankatesh. Applicants Ankush and Shrikant were sitting along with co-accused Vyankatesh. Whereas, Rakesh was sitting along with accused Deepak. 7.
In view of the aforesaid nature of accusations made against applicants in these applications, applicants are entitled to be released on bail. That leads me to pass following order:
ORDER
(1) Criminal applications are allowed.
(2) Applicants Deepak @ Dilip s/o Dhiwru Kukadkar; Ankush Chandrashekhar Bahirwar;
Shrikant Tirupati Bahirwar; and Rakesh Pandurang Bahirwar, in connection with Crime No.54/2019 registered with Dhanora Police Station, District Gadchiroli for offences punishable under Section 307 read with Section 34 of the Indian Penal Code and under Sections 65(a)(e), 83, and 98 of the Maharashtra Prohibition Act, 1949, be released on bail on their executing a P.R.Bond in the sum of Rs.10,000/- by each of them with one solvent surety of the like amount by each of them.

(3) Applicants shall attend the police station once in 15 days i.e. twice a month i.e. on 1st and 3rd Saturday of every month, till trial is over.
With this, criminal applications stand disposed of accordingly.
