Mr. G. B. Hemke, Advocate for applicant.
Mr. T. A. Miza, A.P.P. for non applicant-State. CORAM : V.M. DESHPANDE, J.
DATED : DECEMBER 20, 2017 1.
Heard Mr. G. B. Hemke, Advocate for applicant and Mr. T. A. Miza, A.P.P. for non applicant-State. 2.
Mr. Hemke, Advocate fairly pointed out that this is second anticipatory bail application. The earlier one was withdrawn by him on 01.11.2017. According to him, the change in circumstance is; subsequent to said withdrawal, the mother of the applicant is released on regular bail. 3.
Consideration for granting anticipatory bail and regular bail are different. Merely because mother of the applicant is released on regular bail, in my view, it cannot be termed as change in the circumstance. Consequently, the present application is required to be rejected and it is rejected accordingly.
