Challenge is to the order of the learned Judicial Magistrate First Class, Ghatanji in Summary Criminal Case 657/2016, by and under which, the application of the original complainant seeking addition of the Co-operative Society as a party is allowed.

2] Six of the applicants have filed an affidavit on record stating that Rs.35,000/- shall be paid by cheque dated 13.07.2018 which shall be handed over to the learned counsel for the non-applicant today and the balance amount of Rs.5,29,071/- shall be paid along with the interest on deposit in saving bank account on or before 30.06.2019.

3] In view of the affidavit, the proceedings before the Trial Court are disposed of as amicably settled.

apl881.17.O.odt 2 4] The assurance is in the affidavit are accepted as an undertaking to this court. Any breach of the undertaking shall entail initiation of proceedings under the Contempt of Courts Act.

5] The criminal application is disposed of in view of the amicable settlement of the dispute.
