This is an application for seeking condonation of delay of 228 days in filing Civil Revision Application. 2.

The applicant is challenging order dated 07.02.2024 passed by learned Motor Accident Claims Tribunal No.3 in Motor Accident Claim Petition No.999 of 2018, whereby he is ordered to be added as respondent in the said claim petition. It is stated that notice/summons were served on the applicant on 15.09.2024. He further states that respondent No.5 and he had agreed that they will file revision together. However, respondent No.5 filed the revision without informing him. If the delay is computed from the date of service of notice/summons, the limitation of 90 days will expire somewhere around mid of December, 2024. The contents of the application are not disputed by filing affidavit in reply.

In view of the above, in the considered opinion of this Court, the delay of 228 days in filing Civil Revision Application is deserved to be condoned.

Therefore, the Civil Application is allowed.

The office is directed to register the Civil Revision Application.
