Heard learned counsel Shri M.V.Rai for the applicant and learned Additional Public Prosecutor Shri P.S.Tembhare for the State. Also, perused reply filed on behalf of the State.

After hearing learned counsel for parties and when the Court expressed its opinion that the Court is rejecting the application, learned counsel Shri M.V.Rai for applicant submitted that he wishes to withdraw the application.

The criminal application is rejected as withdrawn.

Since learned counsel for the applicant is withdrawing the application, the Court is not giving detailed reasons for rejection of the application.

It is made known to this Court that in Sessions .....2/-

ba1208.19 9 Case No.167/2019 in which the applicant is accused, charge is already framed.

In this view of the matter, learned Additional Sessions Judge, Akola is directed to decide Sessions Case No.167/2019, in accordance with law, within a period of 9 months from date of receipt of writ of this order. JUDGE !! BRW !!
