Apprehending the arrest at the hands of police in connection with Crime No.1185/2024 registered with Police Station Saoner, District Nagpur for the offences punishable under Section 3 of the Prevention of Damage to Public Property Act, 1984 and Sections 61(2), 324(5), 347(2), 318(2), 336(3) and 341(2) of the Bharatiya Nyaya Sanhita, 2023, the applicants approached this Court for grant of pre-arrest bail.

Learned Counsel for the applicants submitted that the allegation against the present applicants is that they have caused the loss to the Government property to the tune of Rs.10.00 lakhs. On the basis of the said report, police have registered the crime. He submitted that now the bus stand is already constructed by the present applicants. They are also cooperating with the investigating agency. Now, the investigation is completed, therefore, the custodial interrogation of the present applicants is not required.

Learned APP though objected the said application but admitted that investigation is completed and charge-sheet is likely to be filed.

Considering the fact that, the applicants have already cooperated with the investigating agency and as far as their custodial interrogation is concerned which is not required as nothing is to be recovered from them. In view of that, the application deserves to be allowed. Accordingly, I proceed to pass following order: (i) The application is allowed.
(ii) In the event of arrest, the applicants i.e.
applicant No.1) - Mohan Sudhakar Pinjare, 2) Shri Narendra Bhauraoji Virkhare, 3) Shri Gopal Santosh Sonbarse and 4) Shri Naresh Santosh Sonbarse in connection with Crime No.1185/2024 registered with Police Station Saoner, District Nagpur for the offences punishable under Section 3 of the Prevention of Damage to Public Property Act, 1984 and Sections 61(2), 324(5), 347(2), 318(2), 336(3) and 341(2) of the Bharatiya Nyaya Sanhita, 2023, be released on anticipatory bail, on executing P.R. Bond in the sum of Rs.25,000/- each with one solvent surety each in the like amount.
(iii) The applicants shall attend the concerned police station once in a week i.e.
on every Sunday between 10.00 AM and 1.00 PM, till filing of the charge-sheet and shall cooperate with the investigating agency.
(iv) The applicants shall not induce, threat or promise any witnesses who are acquainted with the facts of the case either personally or by way of electronic media.

The contravention of any of the condition would lead to the cancellation of bail.

The application is disposed of.
