After hearing learned counsel for the parties when the Court has shown its inclination not to grant bail to the applicant, the learned counsel for the applicant Mr.Nayak submits that in that eventuality he will be withdrawing the application for bail. However, he submitted that the trial may be expedited.

The applicant is facing prosecution at the hands of Police Station, Gittikhadan, Nagpur for an offence punishable under Section 401 of the Indian Penal Code. The case is already registered as Regular Criminal Case No.3944/2017 and it is pending on the file of Judicial Magistrate First Class, Court No.10, Nagpur. The offences are triable by the Court of Magistrate. Looking to the nature
ba1240.17.odt of evidence that is brought on record, I am of the view that the ends of justice will be met if the Court below is directed to decide and dispose of Criminal Case No.3944/2017 within a period of six months from the date of receipt of this order.

Mr. Pathan, the learned A.P.P. for the State, upon instructions from the investigating officer makes a categorical statement that the prosecution will extend full cooperation to the learned Magistrate in deciding the criminal case within the stipulated period and will not unnecessarily move applications for adjournment. 5.
The learned Magistrate is also directed to procure presence of the present applicant on the necessary dates of trial, without fail.
With these observations, the application is allowed to be withdrawn and disposed of accordingly. JUDGE kahale
