Heard Mr. Jaltare, learned counsel for applicant and Mr. Pathan, learned Additional Public Prosecutor for non applicant-State. Also perused the reply filed on behalf of the prosecuting agency.

The applicant is apprehending his arrest in connection with Crime No.442/2019 registered with Police Station, Durgapur Tah. and Dist. Chandrapur for an offence punishable under Section 354 of the Indian Penal Code. The victim is working at WTP-3, Unit 8 and 9 in Chandrapur Super Thermal Power Station (CSTPS) as a Junior Lab Chemist on contract basis. The applicant was also working there as Senior Chemist, on the day of the incident i.e. on 07.12.2019. The working hours of the applicant were 12:00 a.m. to 08:00 a.m. Since, his reliever did not remain present, he was present in the office. According to the prosecution case when the victim was doing her work, that time applicant came there and caught hold her hand. Therefore, the victim asked as to why he caught hold her hand. According to prosecution, the applicant said that he has given good wishes of

aba900.19.odt "Mahaparinirwan Day". At that time, according to prosecution, victim replied that it is not a day to give good wishes.

This Court on 02.01.2020 granted interim protection in favour of the applicant on a condition that applicant shall attend police station from 05.01.2020 to 15.01.2020. Applicant has attended the police station is the statement made by the learned Additional Public Prosecutor on the instructions revived from the investigating officer. In that view of the matter, I pass the following order:

ORDER

(i) The application is allowed.

(ii) In the event of arrest in connection with Crime No.442/2019 registered with Police Station, Durgapur, Tah. and Dist. Chandrapur for an offence punishable under Section 354 of the Indian Penal Code, applicant - Raju s/o Zita Pawar be released on bail on he executing P.R. bond in the sum of 10,000/- with one solvent surety in the like ₹ amount.

(iii) Applicant is directed to attend the Police Station, Durgapur Tahsil, Dist. Chandrapur twice in a week i.e. on every Thursday and Saturday and shall be with the investigating officer from 11:00 a.m. to 05:00 p.m., till filing of the charge-sheet.

The application is disposed of.
