By present application, the applicant-informant is seeking to condone delay of 276 days in filing appeal against judgment and order dated 03/05/2024 passed by the learned Additional Sessions Judge, Nagpur in Sessions Case No.570/2019.

The counsel for applicant submits that delay has occurred because the applicant was suffering from Dengue, his shop was burned and therefore he was in financial crisis as well. 4.

The counsel for respondent No.2 has no serious objection nor has learned Additional Public Prosecutor to allow the application. 5.

In view of above and for the reasons set out in the application, application is allowed as prayed for. 6.

Delay is condoned. Appeal be registered and process as per Rules.
