DATED : JANUARY 8, 2018 Heard Mr. N. A. Chawhan, Advocate for applicant and Mr. M. Pathan, A.P.P. for non applicant-State. Perused the reply filed on behalf of the prosecution. The present application is filed in connection with Crime No.1488/2017. In reply, learned A.P.P. has pointed out that applicant is not accused in Crime No. 1488/2017 however he is shown as an accused in Crime No.1489/2017. Mr. Chawhan, Advocate for the applicant submits that at no point of time, he had moved an application for anticipatory bail in connection with Crime No.1489/2017. He therefore submits that presently he wishes to withdraw the present application with liberty to file an application for anticipatory bail before the learned Sessions Judge seeking anticipatory bail in Crime No.1489/2017.

The application is allowed to be withdrawn with liberty as prayed for. It is made clear that the case of the present applicant is not heard on merits by this Court in connection with Crime No.1489/2017.

The application is disposed of as withdrawn.
