This matter was heard for some time.

The learned Advocate for the petitioner submits on instructions that the petitioner desires to withdraw this petition and all contentions of the parties, in view of their pleadings before the trial Court in Regular Civil Suit 203 of 2012, may be kept open.

The learned Advocate for the original plaintiff submits that the suit is already 8 years old. This is a second round of litigation upto the High Court. The evidence of the defendants was to be recorded after the plaintiff concluded the recording of his oral evidence and in the last 4 years, the defendants have not led evidence. He therefore, prays for a limitation of one month to be granted to the defendants to complete the recording of their oral evidence. 4.
Considering the above, this petition is disposed
