Heard learned counsel for the petitioner.

At the outset, he fairly states that Securitisation Application No. 45/2018 is pending before the Debts Recovery Tribunal, Nagpur, and his grievance would be redressed if the said application is directed to be decided within time bound period. He has also invited our attention to the order passed by the Hon'ble Apex Court in the case of Indian Overseas Bank vs M/s Radhey Infra Solutions (Pvt) Ltd. And others in Civil Appeal No. ___ of 2025 (Arising out of SLP (C) No.21255/2025) dated 07/10/2025.

Considering the fact that directions have been given by the Hon'ble Apex Court, we permit the petitioner to file an appropriate application for grant of early hearing before the Debts Recovery Tribunal. If such application is made, the Tribunal is directed to decide the same in the light of the directions issued by the Hon'ble Apex Court in the case of Indian Overseas Bank (supra) within a period of four weeks from the date of filing of the application. rkn

So far as the amount of Rs. 18,64,69,794/- (Rupees Eighteen Crores Sixty Four Lakhs Sixty Nine Thousand Seven Hundred Ninety Four only), which is deposited by the petitioner in no-lien account, learned counsel for the Bank fairly states that if any application is made by the petitioner for withdrawal of the same, the amount would be transferred within two days.
