Heard Shri R.S. Renu, the learned counsel for the petitioner and Shri J.Y. Ghurde, the learned APP for the respondents-State. The prayer clause (iii) in this petition is as follows : (iii) "During pendency of the petition direct the respondent no.3 to release the said vehicle (truck) bearing registration number MH-27 X-7599, in favour of petitioner."
Admittedly, the learned counsel for the parties make a joint statement that during the pendency of the petition, proceedings initiate are complete and vehicle bearing registration no.MH-27-X-7599 is already released and is in possession of the petitioner. In view of statement made aforesaid and having considering the prayer in the petition for release of vehicle, the petition is found rendered infructuous, same is therefore disposed of as infructuous.
