Heard Shri R.M. Daga, learned counsel for the applicant and Shri S.D. Sirpurkar, learned APP for the respondent - State.

Perused the charge sheet. The statement of victim shows that she was aged about 19 years. Her statement shows that she had love affair with the applicant. She conceived from the applicant and delivered a child. The child died at the time of delivery. The applicant refused to perform marriage with her. It appears from her statement that relationship was going-on with her consent and she was major. They were aware of the consequences. Hence, the following order :

The application is allowed.

(i) The applicant be released on executing PR bond of Rs.25,000/- with a solvent surety of like amount. (ii) He shall not tamper with the prosecution witnesses.

(iii) He shall attend the trial on each and every date before the trial Court.

(iv) He shall attend the Police Station Ballarsha, Dist. Chandrapur, once in a month till the completion of trial. JUDGE *GS.
