In this petition, the petitioner has challenged the orders passed by the subordinate Courts by which it is held that she is disqualified from continuing as Sarpanch and Member of Grampanchayat. The disqualification is under Section 39 of the Maharashtra Village Panchayats Act, 1959 (for short "the Act of 1959").
By order dated 31st March 2016, the Additional Collector disqualified nine Members of the Grampanchayat under Section 14-B of the Act of 1959 as they failed to submit accounts of election expenses within time. The order passed by the Additional Collector was challenged by seven such Members in Writ Petition No.2336/2016 which is dismissed today. The disqualification of seven Members, including the present
2 wp109.19 petitioner, is upheld.
As the disqualification of petitioner under Section 14-B of the Act of 1959 is upheld while dismissing the Writ Petition No.2336/2016, the challenges raised in the present petition have become academic. Hence the writ petition is dismissed. No costs.
