Heard Shri S. Paliwal, learned counsel for the applicant.

The applicant is in Tihar Jail, New Delhi. He is also facing trial in the Sessions Court, Nagpur for the offence punishable under Narcotic Drugs & Psychotropic Substances Act, 1984 (N.D.P.S. Act). It is submitted that the marriage of his son is to be performed on 15.12.2018, therefore, it is prayed that he may be released on temporary bail.

Shri C.A. Lokhande, learned APP has strongly objected to grant of bail application and submitted that he may not return to jail and the trial may be hampered. At last, he submitted that if he is to be released on bail, he be taken to marriage in police escort at his expenses. A copy of the invitation card is placed on record. The marriage is to be performed on 15.12.2018 and marriage ceremonies are to start from 10.12.2018 to 16.12.2018.

Last year also the applicant was released on temporary bail by this Court vide order dated 04.12.2017 in

0712ba1081.18 BA No. 1166 of 2017. As per said order, he was directed to be released on temporary bail.

The learned counsel has submitted that as per the order of this Court, the applicant had returned to Tihar Jail on 16.12.2017.

Looking to the urgency i.e. marriage of son of the applicant, he be released on temporary bail for a period of 15 days on executing P.R. Bond of Rs.50,000/- with one surety of like amount. The applicant shall attend Tilak Nagar Police Station, New Delhi, once a day and he shall report back to the Superintendent, Tihar Jail, New Delhi on 21.12.2018.

A copy of this order be furnished to the learned counsel for the applicant.
