Having heard the learned Counsel for the applicant and having gone through the contents of the application, I find that sufficient cause is made out for condoning the delay. Hence, the delay in filing the first appeal is condoned. The civil application is allowed. FIRST APPEAL ST. NO.27238/2017 Heard.

The appellant as well as the respondent nos.1 to 5 are entitled to withdraw the amount as per the terms and conditions mentioned in the pursis. The appellant is entitled for refund of the court fee, as per rules.

The first appeal stands disposed of. No order as to costs.
