DATE : 22/12/2025 1) The applicant is arrested in Crime No.106 of 2025 registered with Police Station, Pimpalgaon Raja district Buldhana for the offence punishable under Sections 109(1), 118(1), 126(2),115(2),351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023.
2) It is the case of the prosecution that the applicant has assaulted the injured and his family members with spade and other accused persons assaulted with wooden stick. The injured had head injury. He was hospitalized. The brother of the injured has lodged the complaint. The learned counsel for the applicant has stated that other accused persons are already released on bail, there is counter
2 / 4 48-ba 1295-25 complainants against each other. Earlier, the offence under Section 118(1) was registered, as he was hospitalized in private hospital. The offence punishable under Section 109 of the Bharatiya Nyaya Sanhita,2023 was registered. The injured was discharged from the hospital within five days and thereafter, he was admitted. Now he is discharged from the hospital. The charge-sheet is filed, the other co- accused are already released on bail. Hence, prayed to release him on bail.
3) The learned APP has opposed the application stating that the assault was with spade therefore, the trial court has rejected the application of this applicant. They are from same family. Though the counter First Information Reports are there, the injured was having grievous injury and he was admitted for twice. Considering the gravity of the offence, prayed to reject the the application. 4) Heard both the sides and perused the record.
5) The counter First Information Reports are filed against each other. Both are from same family and there was dispute between both of them. The crimes are registered against each other. As the spade was used, the offence under Section 109 is registered. Now the investigation is completed and the spade is also produced by this applicant.
3 / 4 48-ba 1295-25 6) There is no need to keep the applicant behind the bar. Hence, the case is made out to release the applicant on bail. Accordingly, I pass the following order:
i) Criminal application is allowed.
ii) Applicant- Milind @ Satish Prakash Herode be released on bail in connection with Crime No.106 of 2025 registered with Police Station, Pimpalgaon Raja district Buldhana for the offence punishable under Sections 109(1), 118(1), 126(2), 115(2), 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023 on his furnishing P.R. Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with solvent surety in the like amount before the trial Court. iii] The applicant shall not in any way tamper with the prosecution evidence.
iv] The applicant shall not pressurize or threaten the prosecution witnesses.
v] The applicant shall co-operate the learned trial judge in the conduct of the trial. vi] The applicant is restrained from entering into the village, Poraj tq. Khamgaon district Buldhana till the conclusion of the trial.
