This is an application for grant of bail.

Heard learned counsel Shri A.M. Kukday for the applicant and learned Additional Public Prosecutor Shri N.B. Jawade for the State.

The applicant is arrested on 6.6.2017 in connection with Crime No.240 of 2017 registered with Police Station Pusad City, District Yavatmal for the offences punishable under Sections 306, 498A, and 504 read with Section 34 of the Indian Penal Code.

The crime was registered on the basis of the report lodged by father of deceased Sau. Vanita Anil Rathod whose marriage took place with the applicant on 30.5.2006. Vanita committed suicide on 6.6.2017 by hanging. Since she committed suicide after 11 years, even statutory presumption cannot be pressed against the applicant.

The charge-sheet is already filed.

In view of the said and looking to the nature of accusations made against the present applicant, I see no reason not to grant bail in favour of the applicant. Hence, I pass the following order:

ORDER

(a) The criminal application is allowed.

(b) Applicant Anil Amarsingh Rathod, be released on bail on his executing a P.R. Bond in the sum of Rs.25,000/- with two solvent sureties of the like amount, in connection with Crime No.240 of 2017 registered with Police Station Pusad City, District Yavatmal for the offences punishable under Sections 306, 498A, and 504 read with Section 34 of the Indian Penal Code.

(c) The applicant shall not influence any of the prosecution witnesses.

(d) With this, the criminal application is allowed and disposed of.
