DATED : 06-08-2025 Learned Advocates for both parties have submitted that the matter has been amicably settled between the parties. Accordingly, they have filed the settlement agreement/ consent terms before the learned Mediator. As such, learned Advocates for both parties urged for the disposal of the appeal in terms of the settlement agreement/consent terms, which was verified before the learned Mediator.

It appears that by order dated 13-03-2025, the matter was referred for mediation. Accordingly, the Coordinator of the Mediation Centre submitted the report that the matter is settled between the parties and the mediation is successful. Along with the report, he has also annexed copies of the settlement agreement/consent terms executed between the parties before the learned Mediator. In the said settlement agreement/ Consent terms, parties No. 1 and 2 therein had put their signatures before the learned Mediator in the presence of their respective Advocates and attested the consent terms therein.

As per the settlement agreement/consent terms, party No. 2, i.e. original claimants, undertake to withdraw Special Darkhast No.38/2023 pending before the executing court. Similarly, party No. 1, i.e. the appellant, has given consent to withdraw the amount of Rs. 13,18,608.31 along with accrued interest thereon lying in the Court by party No. 2. 4.
In view of the above, the appeal is disposed of in terms of the settlement agreement/consent terms. The Award is to be prepared accordingly.
