Heard learned counsel Shri Abhay Sambre for the applicant and learned Additional Public Prosecutor Shri V.A. Thakare for the State so also perused the reply. 2.

According to the reply, on 17.8.2017 the Assistant Police Inspector lodged a report that he got a secret information that the vehicles are coming from Wani to Wandhari Fata having contraband liquor in it. The vehicles were intercepted and that time Sunil Uike, Raj Khanjar, Shubham Wankhede, and Shankar Nagbhidkar were apprehended and they were arrested and shown as accused. According to the reply, the Mahindra vehicle, in which contraband liquor was found, is registered in the name of the applicant. That is the only reply and accusation against present applicant.

This Court, on 21.12.2017, granted interim protection to .....2/-

aba920.17 22 the applicant on the conditions that the applicant shall attend Padoli Police Station, District Chandrapur on 28.12.2017, 3.1.2018, and 5.1.2018. Also, he was directed to remain present with the investigating officer from 11:00 a.m. to 5:00 p.m.. 4.

Learned counsel Shri Abhay Sambre for the applicant submits that as per the interim protection granted by this Court, the applicant has attended the police station on those dates and was with the police officer. This particular statement is not controverted by learned Additional Public Prosecutor Shri V.A. Thakare for the State.

Thus, the investigation insofar as interrogation must have been completed. Further, the only allegation against the present is that he is the registered owner of the vehicle. Except this, there is no allegation against him.

In that view of the matter, this Court passes the following order:

ORDER

(i) Interim protection granted by this Court on 21.12.2017 stands confirmed.

(ii) The criminal application stands disposed of. JUDGE !! BRW !!
