Heard learned counsel Mrs. Prajakta Chaudhari for applicant Nos.1a to 1f/respondents, learned counsel Mrs. P.P. Chobe for the appellant, and learned Assistant Government Pleader Shri Amit Balpande for respondent Nos.2 and 3.

This is an application for withdrawal of amount deposited by the appellant before this Court. The appellant has deposited entire decretal amount. 3.

Learned counsel Mrs. P.P. Chobe for the appellant submits that the claimants placed in similar circumstanced had moved application before this Court .....2/-

cao1206.18 30 for withdrawal of amount and their application was allowed by this Court (Coram : S.B. Shukre, J.). 4.

The present application is not replied in that behalf by the applicants.

In that view of the matter, the present application is allowed.

Applicant Nos.1a to 1f/respondents are entitled to withdraw 50% of the amount deposited before this Court on they furnishing solvent surety to the satisfaction of the Registrar (J.) and remaining amount on furnishing usual undertaking. 6.

With this, the civil application stands disposed of accordingly.
