DATED : 21st November, 2025 Criminal Application (APPA) No.965/2025 The applicant-appellant is seeking interim temporary bail to attend the last rites of his wife who expired on 20/11/2025.

The appellant-applicant has been convicted for the offence punishable under Sections 363, 376 (B) of the Indian Penal Code r/w Sections 5(m) and 6 of Protection of Children from Sexual Offences Act, 2012. He is sentenced to suffer Rigorous Imprisonment for twenty years and to pay fine of Rs.30,000/-.

The counsel for the applicant submits that applicant was on bail during trial. He has never jumped the bail or misused the liberty granted to him. His wife has expired yesterday. The certification of death issued by the hospital is annexed with the application.

We have requested learned Additional Public Prosecutor to take instructions on this point. Accordingly, he has taken instructions and submits that the wife of the applicant has indeed expired yesterday.

That being so, we are of the view that the applicant should be released on temporary bail on humanitarian ground.

Accordingly, the application is partly allowed. 6.

The applicant Moreshwar Madhukar Kevat is ordered to be released for six days from 24/11/2025 to 29/11/2025 purely on temporary bail on humanitarian ground to attend the last rites of his wife on furnishing PR Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one or two sureties in the like amount to the satisfaction of Additional Sessions Judge, Wardha. 7.

The applicant shall report to Arvi Police Station on 25/11/2025 and 27/11/2025 between 1 pm to 4 pm. 8.

The applicant shall not leave the limits of Wadgaon Pande, Tah. Arvi, District Wardha during the aforesaid period. 9.

The applicant shall surrender before the Superintendent of Central Jail, Nagpur by 6 pm on 29/11/2025. 10.

It is made clear that no prayer for extension of period of temporary bail beyond 29/11/2025 (6 pm) will be entertained on any ground whatsoever.
