Heard Shri Rizwal Ali, learned counsel for the applicant, Mrs. H. Prabhu, learned APP notice for nonapplicant No. 1 and Shri S.B. Dhole, learned counsel for non-applicant No. 2.

The learned counsel for non-applicant No. 2 has no objection in allowing this application, although the learned APP has. However, considering the fact that the applicant is in jail, some delay in filing of Appeal of the present nature is quite likely and at least the delay, which has occurred in this case, has not been shown to be the result of any malafide action on the part of the applicant. Therefore, application is allowed. Delay is condoned. Appeal be registered forthwith. Application is disposed of accordingly.
