The learned Counsel appearing for the petitioner submits that the order under challenge is dated 08.08.2024, whereby the complaint filed by the petitioner under Section 138 of the Negotiable Instruments Act came to be dismissed for want of prosecution. He further submits that wrongly present writ petition was filed, when appeal was maintainable and therefore, seeks permission to withdraw the present petition with liberty to file appeal.
