At the outset, Mr. Madiwale, learned A.P.P. for the State made a statement that during the pendency of present application, charge-sheet is filed before the Court. 2.

On such a statement being made, Mr. Wadodkar, learned counsel for the applicant, submits that he wishes to withdraw the present application. However, he prays for liberty to file an application for grant of bail before the learned trial Court.

The application is allowed to be withdrawn with liberty to file an application for grant of bail, afresh before the trial Court. It is made clear that this Court has not heard the case on its own merits.

The application is disposed of accordingly.
